♡Terms and Conditions♡
Here is a more detailed version of my terms and conditions that I encourage you to read.
IMPORTANT:
By requesting an art commission from me, you automatically agree to the following terms of service.
1. GENERAL TERMS
All illustrations will include a watermark/signature, which must not be removed (see point 5 on Copyright & Usage Policy).
I, Peekoe (the artist), reserve the right to reject any commission request that I do not feel comfortable undertaking.
2. PAYMENT
Payments are accepted in USD via PayPal.
All payments are final. Once your request is accepted, refunds will not be available.
3. PRICING
Prices that are posted DO NOT include add-ons.
Prices are subject to change at my discretion. If you have previously commissioned me at a lower price, the current active price will apply to your new commission.
4. PROCESS AND DELIVERY
After payment is received, I will provide you with a rough sketch to discuss the key details of your piece.
You can review the sketch and request modifications to the pose or composition before I begin adding color.
Once you approve the sketch, you will receive updates throughout the process.
The completed artwork will be emailed to you in digital format within three weeks of payment. If delays occur due to external factors such as my health, availability, or client response time, you will be notified.
Significant changes requested later in the process may incur additional charges or may be denied. I reserve the right to decline any request for substantial changes.
5. COPYRIGHT / USAGE POLICY
I, Peekoe (the artist), retain ownership of all produced artwork unless otherwise specified in a contract. As the copyright holder, I have the rights to:
A) Post the piece on my social media, portfolio, or website at any time.
B) Make modifications to the artwork after delivery for personal or commercial use, including reusing poses, compositions, or color palettes (this does not include character designs that belong to the client unless previously discussed).
C) Use the artwork for self-promotion.
Clients may use the artwork for personal purposes only, which includes:
A) Printing the artwork for personal use.
B) Claiming the character(s) included as their own, provided no other entity holds copyright over them.
C) Posting or using the artwork on social media with proper credit, provided no monetary profit is gained.
Clients are NOT permitted to sell, modify, reproduce, or profit from the artwork in any form, including but not limited to merchandise, prints, stickers, NFTs, or digital assets. Engaging in any of these activities will result in copyright infringement.
If a client wishes to use the artwork for non-personal purposes, they may request to purchase commercial rights under a separate contract. Additional fees will apply, and I may refuse to grant commercial rights for pieces originally commissioned for personal use.
Significant changes requested later in the process may incur additional charges or may be denied. I reserve the right to decline any request for substantial changes.
6. CANCELLATION POLICY / REFUNDS
Clients cannot request a refund once I have started working on their commission.
If I am unable to start or complete the commission due to unforeseen circumstances, I will issue a full refund, and the commission will be canceled.
For refunds, please do not initiate a PayPal chargeback; I will transfer the money directly to you.
If you request a chargeback without being eligible for a refund, your commission will be immediately canceled, and the chargeback will be declined. I will provide PayPal with our conversation as proof that the terms and conditions have been violated. Furthermore, you will be blacklisted from future commissions.
If the client violates any terms and conditions, they will forfeit all rights to the commissioned artwork, and I will retain full ownership to profit from it as I see fit.
7. CUSTOMER SATISFACTION
Ensuring your satisfaction with your commission is my top priority. If you have any concerns regarding the artwork, please reach out so we can work towards a solution (as long as it complies with the aforementioned terms).
While I strive for 100% client satisfaction, it’s important to note that expressing dissatisfaction does not entitle you to a refund (refer to point 6). Clients have multiple opportunities to communicate any issues during the process to avoid such outcomes (see point 4 on revisions).
